Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Flexity Automation LLC ("Flexity", "we", "us"), based in Spokane, Washington, USA, and govern your use of the Flexity website at flexity.ai and our AI application-building platform (together, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

Flexity is an AI-powered platform that helps you design, build, preview, and deploy web applications from natural-language prompts.

We may add, change, or discontinue features at any time. We aim to give reasonable notice of material changes that adversely affect paid features.

To use most features you must create an account, and you must be at least 13 years old (or the minimum age of digital consent in your jurisdiction). You agree to:

• Provide accurate account information and keep it up to date.
• Keep your credentials confidential and secure.
• Be responsible for all activity that occurs under your account.
• Notify us promptly of any unauthorized use of your account.

You agree not to use the Service to:

• Violate any law or regulation, or infringe the rights of others.
• Build, host, or distribute malware, spam, or content that is unlawful, harmful, or abusive.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer or misuse the Service except as permitted by law.
• Generate content that violates our providers’ or Meta’s policies.

You retain ownership of the prompts, code, and applications you create with the Service ("Your Content"), subject to the rights of any third-party components or models involved.

You grant Flexity the limited rights needed to host, process, and display Your Content in order to provide the Service.

You are responsible for Your Content and for the applications you build and deploy, including making sure they comply with applicable law and third-party terms.

The Service offers an optional integration with the WhatsApp Business Platform, in which Flexity acts as a Tech Provider that connects your own WhatsApp Business Account to the Service through Meta’s Embedded Signup.

If you use any Meta or WhatsApp functionality, you agree to comply with all applicable Meta and WhatsApp terms and policies, including the Meta Platform Terms, the WhatsApp Business Messaging Policy, and the Meta Developer Policies, in addition to these Terms.

You are responsible for the messages you send and for obtaining any consents required from the people you message. Meta may change or restrict its platform at any time, which may affect this integration.

Paid plans are billed in advance on a recurring basis (for example, monthly or annually) through our third-party payment processor. By subscribing, you authorize us to charge the applicable fees to your payment method.

Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.

Except where required by law, fees are non-refundable. We may change our prices with reasonable advance notice, effective at your next billing cycle.

The Service, including its software, design, and trademarks, is owned by Flexity Automation LLC and its licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in our brand or software except the limited right to use the Service.

The Service integrates third-party services, including AI model providers, hosting and infrastructure providers, a payment processor, and Meta / WhatsApp. Your use of those services may be subject to their own terms, and we are not responsible for third-party services.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI-generated code and content may contain errors or be incomplete. You are responsible for reviewing, testing, and securing anything you build or deploy with the Service. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Flexity Automation LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred US dollars (US$100).

You agree to indemnify and hold harmless Flexity Automation LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, the applications you build, or your violation of these Terms or applicable law.

You may stop using the Service and close your account at any time.

We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; provisions that by their nature should survive (such as ownership, disclaimers, limitation of liability, and indemnification) will survive.

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Washington will have jurisdiction over any dispute not subject to arbitration or small-claims resolution, to the extent permitted by law.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
